Martin E. Levin
Martin E. Levin has more than 25 years of government and private practice experience in environmental and other complex litigation.
In private practice, Mr. Levin has represented businesses and individuals in environmental, toxic tort, insurance, and commercial litigation, including the defense of individuals and corporations throughout government enforcement actions for serious workplace injury and environmental violations. He provides counsel to corporations with respect to informal dispute resolution. Notable matters have included:
- Winning class certification and jury trial on behalf of homeowners whose properties were polluted by an off-shore oil spill, resulting in a $12.4 million settlement in compensation for the alleged property damage.
- Successfully undertaking the appeal of an adverse judgment that had denied compensation for contamination at an industrial site; Mr. Levin subsequently won a multimillion dollar settlement for the plaintiff.
- Winning a multimillion dollar settlement for insurance coverage and unfair business practice claims in a case arising from fire at an industrial site.
- Co-lead counsel, along with Max Stern, in the defense of a product supplier charged with manslaughter in connection with the 2006 collapse of the Boston "Big Dig" tunnel. Mr Levin's work in this multi-faceted matter included resolution of civil and criminal claims arising from the tunnel collapse, as well as the successful administrative appeal of federal contract suspension proceedings.
While in government, Mr. Levin was Massachusetts’ chief environmental prosecutor for a decade. He directed investigations into environmental and occupational health hazards. His precedent-setting cases include the civil action against GE for failure to notify the government of PCB contamination caused by company wastes used as residential fill; a record criminal disposition, including the state’s first order mandating corporate audits of occupational safety and environmental compliance, for hazardous waste violations; and the landmark convictions establishing the crime of assault and battery for exposing employees to hazardous materials. Mr. Levin also drafted the state’s public employee whistleblower protection law and environmental endangerment law.
Mr. Levin has appeared and argued at every trial and appellate level, including the United States Supreme Court. He has taught at Harvard Law School and lectured before a variety of business, labor, professional, and academic audiences. He graduated cum laude from Yale College in 1978, and from the University of Virginia School of Law in 1981. He was named one of Lawyers Weekly's Lawyers of the Year for 2011.
